Question that inspired this post:

Hello Friends

I found a job 3 months ago in a company whose salary (about 43K per year) allowed me to apply for passport talent (Before that I had APS visa ''rècherche d'emploi)

So my Talent Visa got accepted and I received my recepicé that said you got accepted for 4 years till 2028 for Passeport Talent . however, my physical card (Titre de sejour) is not ready yet but I guess it will gonna be ok.

Now I have a problem, my company has terminated the 'Period d'essay' of my contract because lack of related projects and missions so from today I am out of a Job!

Now I have some question ...

1. Will this termination affect my Talent visa since they already gave me the 'Decision favorable recepissé'' ?

2. Now I am looking for new jobs ... if my salary is under the Passeport talent Limit (under 43K annually) will it affect my Talent Visa In the short/long term?

3. Am I free to find any job in any category (even far from my expertise) with any salary? Since I have a 4-year Visa? Or since this visa is for the experts or so-called Talents, I cannot do some general jobs?

4. After these 4 years ... if I worked all my jobs with a salary less than Passeport talent limit, would it affect my Nationality process? Is it a negative point?

5. Could I open my own company? Or my own business (anything) with Talent passport ? Or I should change it?

I would appreciate your answers regarding my issues.

Navigating the complexities of the Passeport Talent visa in France can be challenging, especially after losing your job. Here are detailed answers to your questions based on the current regulations and available information:

1. Impact of Job Termination on Your Talent Visa

The termination of your job during the période d'essai (trial period) can potentially affect your Passeport Talent visa. While you have received a favourable decision and a récépissé indicating acceptance for four years, the prefecture has the legal right to invalidate your visa if you no longer meet the initial conditions, such as maintaining employment with the required salary level. It is crucial to inform the prefecture about your job loss and actively seek new employment to maintain your status.

2. Finding a New Job with a Lower Salary

If you find a new job with a salary below the Passeport Talent threshold (approximately €43,000 annually), it may affect your visa status in the long term. The Passeport Talent visa requires maintaining the conditions under which it was granted, including the salary requirement. Therefore, securing a job that meets the salary criteria is important to avoid complications during visa renewals or status checks.

3. Flexibility in Job Categories

The Passeport Talent visa is designed for highly skilled professionals and specific categories of employment. While you are allowed to change employers, the new position should ideally align with the expertise and conditions under which the visa was initially granted. Taking a job far from your expertise or with a significantly lower salary might not fulfil the visa requirements and could jeopardize your status.

4. Impact on Nationality Process

Working jobs with salaries below the Passeport Talent limit over four years can negatively impact your application for French nationality. The nationality process considers various factors, including financial stability and adherence to visa conditions. Consistently earning below the required threshold might be viewed unfavourably.

5. Starting Your Own Business

You can start your own company or business under the Passeport Talent visa, provided you meet the specific requirements for business creation. This includes having a viable business plan, investing at least €30,000, and demonstrating sufficient financial means. If you decide to pursue this route, you may need to apply for a Passeport Talent for company founders or a similar category that aligns with your business activities.

Conclusion

To maintain your Passeport Talent visa and avoid potential issues, it is essential to:

  • Inform the prefecture about your job loss.

  • Actively seek new employment that meets the salary and expertise criteria.

  • Consider the long-term implications of your employment choices on visa renewals and nationality applications.

  • Explore the possibility of starting your own business if it aligns with your goals and visa conditions.

Consulting with an immigration lawyer can provide personalized guidance and help navigate these complexities effectively.
